Bjorn Kreativ operates BJÖRN (getbjorn.ai), an AI-powered marketing platform that helps founders, strategists, and marketing teams research their brand and customers and produce on-brand marketing assets — including brand voice profiles, customer research and empathy maps, campaign angles, email and ad copy, content, and related reporting. Our Service includes:

• Access to our platform and tools
• Customer support services
• Regular updates and improvements
• Security features and data protection

We may modify, update, or discontinue features of our Service at any time. We will provide reasonable notice of material changes that affect your use of the Service.

Fair Use and Usage Limits

To protect the Service and ensure fair access for all users, we may apply reasonable usage limits — including limits on the volume of generations, requests, or outputs within a billing period — and we may throttle, suspend, or adjust access where use is excessive, automated, or inconsistent with normal individual use. 3. Account Registration and Security

To access certain features, you must create an account. You agree to:

Account Responsibility

You are responsible for all activities that occur under your account. You agree to:

• Not share your account credentials with others
• Not create multiple accounts to circumvent restrictions
• Not impersonate others or provide false identity information
• Maintain the security of your account credentials

4. Acceptable Use Policy

You agree to use our Service responsibly and in compliance with all applicable laws. You may NOT:

• Violate Laws: Use the Service for any illegal purpose or in violation of any laws

5. Intellectual Property Rights

Our Rights

The Service and all related content, features, and functionality are owned by Bjorn Kreativ and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Reverse engineer or attempt to extract source code
• Remove or modify any proprietary notices
• Use our trademarks without authorization

Your use of the software is also governed by our End User License Agreement.

Your Rights and Your Content

You retain full ownership of all content you create with our Service.

To protect your privacy and your clients' confidentiality, we do NOT host, store, or back up your content, records, performance data, or any output produced through BJÖRN — including data drawn from connected tools such as Klaviyo, WooCommerce, and similar services. Your projects are saved locally, and any AI generation runs through your own AI provider account.

Because we do not retain your content, you are responsible for keeping your own backups of anything you wish to preserve. We process your content only transiently, as needed to provide the Service to you in the moment.

6. Payment Terms

Pricing and Billing

Current pricing is available on our website. By subscribing to a paid plan:

• You agree to pay all applicable fees
• Payments are processed by secure third-party providers (Stripe)
• All fees are non-refundable unless otherwise stated in our Refund & Cancellation Policy
• We may change pricing with 30 days' notice

Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime through your account settings or by contacting us.

Failed Payments

If payment fails, we may suspend your account until payment is resolved. We will notify you before any suspension.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Service, you also agree to our Privacy Policy.

We implement appropriate security measures to protect your data, but you acknowledge that no method of transmission or storage is 100% secure.

8. Service Availability and Support

Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may perform maintenance that temporarily limits access, and we will provide reasonable notice when possible.

Limitation of Liability

To the maximum extent permitted by law, Bjorn Kreativ shall not be liable for:

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to defend, indemnify, and hold harmless Bjorn Kreativ from any claims, damages, costs, and expenses (including legal fees) arising from:

• Your violation of any rights of others
• Content you upload or share through the Service

11. Termination

Termination by You

You may terminate your account at any time by contacting us or using account settings. Upon termination:

• Your access to the Service will cease
• Your data may be deleted after a reasonable period
• These Terms will no longer apply to future use

Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You fail to pay applicable fees
• We reasonably believe termination is necessary to protect our Service or other users
• Required by law or legal process

We will provide reasonable notice before termination unless immediate termination is necessary for security or legal reasons.

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes will be resolved in the courts located in British Columbia, Canada.

Informal Resolution

Before filing any legal action, you agree to first contact us to attempt to resolve the dispute informally. We commit to working with you in good faith to resolve any issues.

13. Changes to Terms

We may modify these Terms from time to time. When we make changes:

• We will notify you via email or prominent notice on our Service
• Changes become effective 30 days after notification
• Continued use of the Service constitutes acceptance of new Terms
• If you disagree with changes, you may terminate your account

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, End User License Agreement, and Refund & Cancellation Policy, constitute the entire agreement between you and Bjorn Kreativ.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or infrastructure failures.
