End User License Agreement (EULA)

This End User License Agreement ("EULA" or "Agreement") is a legal contract between you ("User," "you," or "your") and BJORN Kreativ ("Company," "we," "us," or "our") governing your use of our software applications, mobile apps, and related services.

Quick Summary: You're granted a limited license to use our software for personal or business purposes, but you can't copy, modify, or redistribute it. We retain all intellectual property rights, and the software is provided "as is" with limited warranties.

1. License Grant and Scope

Grant of License

Subject to your compliance with this EULA, BJORN Kreativ grants you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the software on an unlimited number of devices you own or control
• Access and use the software's features and functionality
• Use the software for personal, educational, or commercial purposes (unless restricted)
• Create backups of the software for personal use only

License Limitations

This license does NOT grant you the right to:

• Distribute, sell, lease, rent, or sublicense the software
• Modify, adapt, alter, or create derivative works
• Use the software for service bureau or hosting services for third parties
• Remove or alter any proprietary notices or labels
• Use the software in violation of applicable laws or regulations

2. Software Restrictions and Prohibited Uses

Technical Restrictions

You are expressly prohibited from:

• Reverse Engineering: Decompiling, disassembling, or reverse engineering the software
• Code Access: Attempting to access or extract source code
• Security Bypass: Circumventing or defeating security measures
• Network Interference: Interfering with the software's network communications
• Unauthorized Access: Accessing areas of the software not intended for users

Usage Restrictions

You may not use the software to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit harmful, illegal, or offensive content
• Interfere with or disrupt our services or servers
• Collect personal information without proper consent
• Engage in fraudulent, deceptive, or malicious activities
• Compete directly with our services using our own software

3. Intellectual Property Rights

Ownership

BJORN Kreativ retains all rights, title, and interest in and to the software, including:

• All source code, object code, and executable files
• Trademarks, trade names, logos, and brand elements
• Copyrights, patents, and trade secrets
• Documentation, help files, and user guides
• Updates, modifications, and enhancements
• User interface designs and user experience elements

Third-Party Components

The software may include third-party components subject to separate license terms:

• Open source software components (see included notices)
• Third-party libraries and frameworks
• Licensed fonts, icons, or media content
• Embedded web browsers or runtime environments

User-Generated Content

For content you create or upload using our software:

• You retain ownership of your original content
• You grant us a license to process and store your content as necessary
• You are responsible for ensuring you have rights to all content you use
• We may remove content that violates our terms or applicable laws

4. Software Updates and Maintenance

Updates and Upgrades

We may provide updates, patches, and new versions:

• Automatic Updates: Some updates may install automatically

Free and Trial Versions

• Trial Limitations: Trial versions may have limited functionality or time restrictions

7. Warranties and Disclaimers

No Warranty

The software is provided "as is, without warranty of any kind." We do not warrant that the software will be uninterrupted, error-free, or free from defects.

Warranty Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING:

• Merchantability: Fitness for a particular purpose
• Non-Infringement: Freedom from third-party intellectual property claims
• Accuracy: Accuracy or completeness of information or results
• Uninterrupted Service: Continuous, error-free, or secure operation
• Compatibility: Compatibility with all systems, devices, or software

8. Limitation of Liability

Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BJORN Kreativ SHALL NOT BE LIABLE FOR:

• Business Losses: Lost profits, revenue, data, or business opportunities

• Third-Party Claims: Claims arising from third-party use of the software

Maximum Liability

9. Indemnification

Termination by Us

We may terminate this EULA immediately if:

• You violate any terms of this EULA
• Your subscription payment fails or is disputed
• You engage in fraudulent or illegal activities
• We discontinue the software or service

Effects of Termination

Upon termination:

• Your license to use the software terminates immediately
• You must uninstall and destroy all copies of the software
• We may disable your access to online features
• Certain provisions (warranties, limitations, governing law) survive termination
• You may lose access to data stored in our services

11. Export Controls and Legal Compliance

• You may not export or re-export the software to prohibited countries

12. General Provisions

Governing Law and Jurisdiction

This EULA is governed by the laws of Alberta, Canada without regard to conflict of law principles. Any disputes shall be resolved in the courts of Alberta, Canada.

Severability

If any provision is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.

Entire Agreement

This EULA, together with our Privacy Policy and any applicable subscription terms, constitutes the entire agreement between you and BJORN Kreativ regarding the software.

Amendment

We may update this EULA from time to time. We will notify you of material changes by email or by posting the updated EULA on our website, and continued use constitutes acceptance.

This EULA is designed to protect both user rights and our intellectual property while establishing clear guidelines for software use.

Referral Programme

BJÖRN may from time to time offer a referral programme allowing an existing subscriber (the “referrer”) to invite a new user (the “referred user”) to create a BJÖRN account using a personal referral link. The following terms govern that programme and form part of these Terms.

Earning a reward. Where a referred user signs up through a valid referral link and completes a qualifying paid subscription, both the referrer and the referred user may each receive one additional month added to their subscription at no charge. A reward is earned only once per referred account, and only where the referred account is genuinely new to BJÖRN.

Limits. A maximum of three (3) reward months in total may be earned by any one account, whether as a referrer, a referred user, or a combination of both. The number of invitations that may be sent within a given period is limited. Rewards have no cash value, are not transferable, cannot be exchanged, refunded or redeemed for money, and apply only to the account that earned them.

Fair use. Rewards are void where a referral is not genuine. This includes, without limitation, referring yourself, creating additional or duplicate accounts, using automated means to generate signups, misrepresenting BJÖRN in order to obtain a referral, or any other conduct intended to obtain rewards other than by genuinely introducing a new user. Where BJÖRN reasonably determines that a referral is not genuine, it may withhold or withdraw the reward, reverse any subscription time already granted, and suspend or terminate the accounts involved.

Changes. BJÖRN may change, suspend or withdraw the referral programme, or any part of it, at any time. Reward months already properly earned and applied will not be removed as a result of the programme ending, save where those rewards were obtained in breach of these Terms.
